Current Legal & Site Position: Reset Execution Under Strict Direct Payment Protocol
Following the failed hoisting of the 165ft dome central compression ring and 20 rafters due to fabrication alignment defects, and primer paint wash-off caused by monsoon rains, all parties executed the Master Final Contract Agreement (`ABM/SBW/MASTER-FINAL-2026/04`) on 04 September 2026. Zero cash advances are permitted; daily actuals are directly disbursed on site from the remaining balance of PKR 989,872.00.
Locked 37.0 Lakh Lump Sum (Base + Addendum)
17 Bank Transfers (2.235M) + Khata 12/13 (475k)
Strictly dedicated for daily actuals & cranes
Txn #21 Furniture (1.925M) + Plants/Solar (885k)
1. Structural & Ring Alignment Defect
During initial erection, the 165ft central compression ring failed to match radial rafter connection points. To avoid collapse, all 20 structural rafters had to be de-rigged to ground level. Ground template rectification, re-drilling, and central ring dimension squaring are contractually mandated before re-hoisting.
2. Monsoon Primer Wash-Off & 37L Advisory
Exposed steel lying through monsoon rains suffered complete wash-away of the initial red oxide primer. Fusion Developers' Advisory Letter proved that lifecycle consumables exceed PKR 535,020, justifying the 37 Lakh lump sum which legally transferred all repainting and consumable costs onto SBW.
3. Performance Cheques & Collateral
To resolve trust deficits, Fusion Developers deposited an unconditional PKR 10,000,000 performance cheque with Albarakah. SBW Engineering deposited Dubai Islamic Bank Cheque #05608194 for PKR 1,490,000 along with the original Smart Card and file for vehicle Honda City LEB-1284-17A.

Technical Advisory: 32 Lakh vs 37 Lakh Contract Evaluation
Commercial evaluation submitted by Fusion Developers proving why the 37L lump sum protects Albarakah. Mathematical proof shows lifecycle consumables equal PKR 535,020 (exceeding Rs. 500k), shifting repainting and consumable escalation risks completely to SBW.
Base Master Contract (FD-SBW-2026-001)
Original base contract defining fabrication, mobile cranes, primer paint, and 20ft brickwork walls. Later subject to dispute when SBW claimed handwritten notes differed from formal typed terms.

Hafiz Abdul Rehman Claims: "SBW started work without making architectural maps, and no maps were provided or approved."
1. Physical Office Meeting with Printed Architectural Map Sets (30 April 2026)
Lala Ayub and Syed Mazhar (SBW) jointly visited Mian Usman's office bringing complete sets of printed architectural CAD drawings and layout blueprints.
Mian Usman filmed the attendees seated at the conference table with the printed blueprints spread across the desk.
2. Immediate Video & Photo Transmission to Hafiz Abdul Rehman (30 April 2026, 17:14 PKT)
Minutes after the physical meeting concluded, Mian Usman transmitted the video recording and a high-resolution photograph of the blueprint title block directly to Hafiz Abdul Rehman's personal WhatsApp (+27846637272):
00000144-VIDEO
00000145-PHOTO
Cryptographic Non-Repudiation: The SHA-256 hashes prove with 100% mathematical certainty that the files received by Hafiz on 30 April are identical to the original meeting recording (00002141-VIDEO) and blueprint photograph (00002142-PHOTO).
3. Hafiz Abdul Rehman's Direct Voice Message Responses (30 April 2026)
Upon receiving the video and blueprint photo, Hafiz Abdul Rehman replied via direct voice messages:
4. Same-Day Multi-Party Corroboration (30 April 2026)
On the exact same evening, the identical files and scheduling instructions were coordinated across the project stakeholders:
-
Sohail Gondal (19:31 PKT): Mian Usman forwarded identical video (
00000106-VIDEO) & photo (00000107-PHOTO). Sohail replied at 19:32 PKT (00000111-AUDIO): "جی ٹھیک ہو گیا عثمان بھائی منڈے مارننگ کو آپ کو پیمنٹ پہنچ جائے گی انشاءاللہ". -
Syed Mazhar / SBW (19:30 PKT): Mian Usman transmitted voice note
5. Subsequent Digital CAD PDF Deliveries to Hafiz Abdul Rehman
In addition to the printed sets and video sent on 30 April, complete architectural CAD PDFs were transmitted directly to Hafiz:
- 08 June 2026 (13:15:06): sent to Hafiz Abdul Rehman.
- 09 June 2026 (11:29:03): sent to Hafiz Abdul Rehman.
Hafiz Abdul Rehman Claims: "We did not inform him about furniture, chairs production, or estimated cost before ordering."
1. Hafiz Abdul Rehman's Own Voice Note Requesting Prices (12 July 2026, 19:23:07)
On 12 July 2026, Mian Usman transmitted 4 videos (00000373 to 00000376-VIDEO) and 5 photos (00000377 to 00000381-PHOTO) showcasing the chairs, head table, and frame prototypes.
At 19:23:07, Hafiz Abdul Rehman responded via voice note:
2. Immediate Itemized Cost Breakdown Disclosed (12 July 2026, 19:24:15)
Mian Usman immediately replied 1 minute later with an exact itemized cost breakdown:
3. Banking Transaction Voucher #21 (PKR 1,925,000) Formally Documented
Payment slip Slip_Txn21_26May2026_Fusion_Furniture_1925k.jpg for PKR 1,925,000 was booked, included in the official statement, and presented in the Comprehensive Audit Dossier without any contemporary objection from Albarakah.
Hafiz Abdul Rehman personally asked for the rates and received them immediately on 12 July 2026. Claiming non-disclosure is an outright falsehood contradicted by his own voice recording.
Hafiz Abdul Rehman Claims: "Albarakah had no direct connection with SBW, did not deal with them, and Fusion bears unilateral responsibility for all defects."
1. Initial 18 April 2026 Contract Named Albarakah Directly as Client and SBW as Contractor
From day one, the foundational agreement executed on 18 April 2026 defines:
Fusion Developers acted solely as the project coordinator and technical mediator. Both principals (Albarakah and SBW) were physically present, agreed to the terms, and signed the operational framework.
2. Shared WhatsApp Group with 93 Direct Communications from Hafiz
On 18 April 2026, the dedicated WhatsApp group Al Barakah Round Marquee Shed was created containing:
Hafiz Abdul Rehman, Sohail Gondal, Syed Mazhar Shamsi, Lala Ayub, Zain, and Mian Usman.
Hafiz Abdul Rehman actively posted 93 voice messages and site inspection videos directly instructing SBW on concrete pouring, center ring alignment, and erection schedules. In multiple voice notes (e.g. 00000316-AUDIO & 00000323-AUDIO), Syed Mazhar addresses Hafiz Abdul Rehman directly:
3. Direct Privity & Gunpoint Extortion: SBW Cheque (PKR 1.49M) & Honda City Extorted
Albarakah dealt directly with SBW to the extreme extent of armed criminal coercion. On 18–19 August 2026, the accused (Ali Akbar, Sohail Gondal, Ameen Gondal) held Syed Mazhar (SBW) hostage at gunpoint, forced the generation of E-Stamp Paper PB-LHR-A5F055987D7A2E27 (paid by Ali Akbar, designating Hafiz as beneficiary), and forcibly extorted:
- Dubai Islamic Bank Cheque #05608194: PKR 1,490,000 (Dated 20-09-2026)
- Vehicle Hostage: Honda City LED-1284 / LEB-1284-17A (Model 2017)
This armed extortion was formally registered with the District Police Officer (DPO) Sheikhupura under Complaint Diary No. 6802/E dated 29-08-2026. If Albarakah had no direct connection or privity with SBW, why did Albarakah's principals generate an E-Stamp paper in the dead of night (11:30 PM) to extort cheques and vehicles directly from SBW?
Sections 182 & 230, Contract Act 1872: An agent who contracts for a disclosed principal does not incur unilateral liability for third-party contractor breaches. Albarakah approved SBW, paid SBW directly, and held direct meetings.
Hafiz Abdul Rehman Claims: "SBW and Fusion caused project delays, resulting in millions of rupees of lost wedding season business."
1. Legal Stay Order on Site Land: Absolute Bar to Lost Business Claims
The marquee site land has been under an active judicial stay order / injunction from a third party. Under Pakistani law, commercial construction on stayed land is strictly prohibited (*status quo* violation) and constitutes contempt of court.
Statutory Principle: A claimant cannot legally demand damages or compensation for "missed wedding season bookings" on a facility that could not legally be completed, licensed, or operated under a court injunction. The client repeatedly halted and resumed erection under legal threat.
2. Client Civil, Demarcation & Power Infrastructure Defaults (May 2026)
- 7–8 Days Demarcation Delay: Civil work commenced around 17–18 May, but client delayed site demarcation by over a week.
- Water Bore Failure: Site water bore was non-functional and unavailable, halting mixing/civil operations for 4–5 days.
- Electricity Default: Client failed to provide the committed heavy power cable and connection, causing 2–3 days delay through their own electrician.
- Forced Material Double-Handling: Because power was not available at the marquee site, the first delivered HR coils/steel plates had to be shifted to an adjacent site, adding 2 days of double transportation.
- Accommodation & Workshop Failure: Client failed to provide the contracted shaded workshop and living quarters. SBW's 30 June statement explicitly billed:
Rent of house 3x10,000 = PKR 30,000andElectric Bill 3x3,000 = PKR 9,000.
3. Physical Assaults & Labour Expulsions by Jaffar & Akbar Gondal
Labour was repeatedly attacked and driven off site by Albarakah family representatives:
-
Team 1 (Junaid & Ameen Weldar): Mr. Jaffar physically fought 2–3 times with Team 1 welders (Ameen Weldar:
+92 308 7820823, Son Junaid:+92 306 1130042— archived in00002125-Ameen Weldar.vcf), forcing the entire team to abandon the site. - Eid-ul-Adha Holidays: 10–12 days of unavoidable nationwide holiday stoppage in mid-June 2026.
- Team 2 (Fayyaz & Javaid, Fabrication Contractors): After Eid, Team 2 arrived under Fayyaz and Javaid (Fabricator/Contractor). Within one week, Akbar Gondal physically confronted Team 2 and expelled them from the marquee, halting work for 4–5 days. Shortly after their return, Jaffar fought again with Javaid. (Note: Javaid is the fabrication team lead, distinct from Advocate Javed Akhtar, Legal Counsel).
4. Crane Mobilized but Column Erection Halted due to Incomplete Backfilling
When SBW called heavy cranes for column erection, Hafiz Abdul Rehman personally stopped the erection because client's civil backfilling around column footings was incomplete (client scope).
This halted work for 3–4 days and forced heavy idling demurrage. In the 30 June 2026 statement (`Line 970`), Syed Mazhar explicitly billed:
"Crane losses = PKR 18,000 | Total Payable = PKR 376,000".
5. Armed Abduction, Gunpoint Extortion of Cheque/Vehicle & 15-Day Labour Vacuum
On 18 August 2026 at 10:30 PM, Syed Mazhar (SBW) and his foreman Rashid were working on marquee erection when Albarakah family principals (Sohail Gondal, Ali Akbar, Ameen Gondal) accompanied by armed gunmen forcibly locked them inside a room under threat of death. The following day (19 August at 7:00 PM), they held a revolver to Mazhar's temple ("revolver kanpat par rakh kar qatl karne ki dhamkiyan") and forcibly extorted:
In the middle of the night (11:30:51 PM on 19-Aug-2026), they forced the signing of Government of Punjab E-Stamp Paper PB-LHR-A5F055987D7A2E27 (paid by Ali Akbar, designating Hafiz as beneficiary).
Mazhar formally filed a criminal application with the District Police Officer (DPO) Sheikhupura (Complaint Cell Stamped Diary No. 6802/E dated 29-08-2026) for FIR under PPC 365-A, 386, 387, 342, 506-II.
Fabrication labour fled into the night to escape armed custody, causing an unavoidable 15-day complete labour stoppage.
Pursuant to police proceedings before the IO at PS Sadar Sheikhupura, accused Muhammad Akbar Gondal surrendered and returned the extorted Honda City LEB-1284 to Syed Mazhar Abbas. However, DIB Cheque #05608194 (Rs. 1,490,000) and E-Stamp PB-LHR-A5F055987D7A2E27 remain unlawfully retained under the conditional pretext of an unproven defect guarantee. Fusion Developers has formally directed SBW Engineering to issue an immediate bank stop-payment and pursue its independent contractor case through Advocate Javed Akhtar.
6. Direct Novation: Hafiz Hired "Asghar & Co." $ightarrow$ Botched Ring (31 July 2026)
In a direct act of contractual novation, Hafiz Abdul Rehman unilaterally hired a third-party outside fabricator ("Asghar & Company") to fabricate the vital central structural ring. Asghar worked for 10 days, completely botched the ring fabrication, faced non-payment and abusive treatment from Hafiz, and abandoned the site.
Hafiz then begged SBW to return and rescue the project. In the contemporaneous recording 00002192-AUDIO (31-Jul-2026 15:43:57 • 95.8s), SBW recorded:
Because Asghar's central ring was fabricated out of true, SBW suffered over 1 additional week of delay during erection to realign and rectify Asghar's defects in mid-air.
7. Hafiz Resided On-Site 24/7 with Zero Formal Written Defect Notices
Hafiz Abdul Rehman physically resided on site from approximately 13 May 2026 to early August 2026 (exiting Pakistan between 2–10 August 2026). He conducted daily verbal inspections and directed welders directly. Under Sections 53 and 54 of the Contract Act 1872, an employer who actively interferes and prevents performance cannot claim delay damages. Crucially, Hafiz never served a single contractual cure notice, written defect memo, or formal engineering complaint to SBW throughout this entire period.
8. Structural Material 100% Compliant & SBW 50% Delay Cost Counter-Claim
All structural steel (5mm, 8mm HR coils and tubing) was procured from verified steel mills (KIB Tube / MA Engineering) strictly per contract specifications. Due to repeated client interference, expulsions, civil scope variations, and double-handling, SBW has officially demanded 50% additional delay and remobilization compensation against Albarakah.
Formal legal statement by SBW Engineering with Annexure A (Hafiz Abdul Rehman daily on-site attendance log across 44 dates), stay order defense, and signature blocks.
Official Criminal Evidence Dossier for SHO / IO / DPO Sheikhupura (Diary #6802/E). Demonstrates heinous cognizable crimes (armed abduction, gunpoint extortion of cheque & Honda City as Bhatta, PPC 365/386/342/506-II/34) and refutes the "civil matter" defense with Supreme Court authorities, proving SBW is the direct contractor from Day 1.
Formal legal instructions directly from Syed Mazhar Abbas (SBW Engineering) to his independent legal counsel: Briefs on PS Sadar SKP settlement, orders bank stop-payment on Cheque #05608194 (Rs. 1.49M), instructs serving formal legal notice on Al-Barakah, and embeds DPO Police Application & Today's IO Verdict in PDF.
The client’s claim for delay losses is completely fabricated. Construction on stayed land is illegal. Delays were caused entirely by client civil failures, physical expulsions of labour by Jaffar and Akbar Gondal, Hafiz’s botched hiring of Asghar, and armed threats that caused labour to flee.
